Unfair competition and intellectual property litigation
Our attorneys have extensive experience in litigating unfair competition cases. Our clients have ranged from private businesses to domestic and global publicly traded companies.
Our attorneys not only have extensive experience in this area, they stay focused and involved in the evolving law affecting enforcement of competitive business practices.
The firm is a member of the International Trademark Association where Tony Swafford serves on the Unfair Competition Committee.
Representative experience includes:
- Successful representation of international public company in defending, and prosecuting, claims of false advertising in various media outlets.
- Successful prosecution of unfair competition case against executive involved in soliciting customers for a competing enterprise, theft of trade secrets, embezzlement and improper access to computer systems.
- Successful injunctive relief against former shareholder for improper use of computer systems and social media outlets, trademark infringement and cybersquatting to direct customers to competing business.
Transportation litigation
The Swafford Group has deep roots in the transportation industry. Tony is a longtime members of the Transportation Lawyers Association where he formerly served as a Board Member. The firm is also a member of the Association for Transportation Practitioners where Tony serves as Vice President and Board member.
The firm has represented both carriers and shippers and in a wide range of litigation disputes including employment discrimination, labor disputes, non-compete agreements, vehicle liability and casualty work, cargo damage claims, breach of contract litigation, white collar defense and intellectual property disputes.
Appellate practice
Our appellant experience includes pursuing and defending appeals in state and federal court across multiple jurisdictions. This work includes cases where our attorneys are called upon to file, or defend, an appeal where we were not involved in the underlying litigation. This includes consulting with trial counsel and assisting on appeals.
Representative experience includes:
- Successfully appeal in 11th Circuit upholding jury trial verdict in favor of client in breach of contract case.
- Represented global public Respondent in successfully upholding ruling in unfair competition injunction hearing.
- Federal appeals of arbitration decisions.
- Amicus brief on behalf of chamber of commerce.
- Representaton of criminal defendant in appeal related to exoneration attempt.
- Represented multiple appellants and respondents in Tennessee Court of Appeals.
